In the event that the USER does not agree to be bound to these terms and conditions, you should stop using it immediately and do not access the "SITE". The terms and conditions set forth in this document are subject to change without prior notice.
DEFINITIONS
For all purposes of the Terms and Conditions set forth herein, means the following definitions:
Travel agency – Company DEMARE TRAVEL SA DE CV, hire and/or acts as an intermediary through its Reservation page www.demaretravel.com., the benefit of a "USER", in respect of the tourist services provided directly by a PROVIDER end, hereafter referred to this company will be referred to as "DEMARE TRAVEL".
Web page – www.demaretravel.com.- Website property of Demare Travel, SA de CV, who acts as an intermediary, offering through the internet to the USER, the various tourist services provides direct PROVIDER, hereinafter referred to as the "SITE".
User or customer – Person using the "SITE" www.demaretravel.com., in order to make use of the intermediation and booking engine of "DEMARE TRAVEL", in order to enjoy any of the tourist services provided directly by the PROVIDER end, hereinafter referred to as "USER".
Provider – Physical or legal person that provides, in the form of direct tourism services to you (the "USER", contracted for, reserved or acquired by the latter through the intermediation and the booking engine of the "SITE" www.demaretravel.com.
Responsibility: DEMARE TRAVEL acts only as an intermediary between the CLIENT and the different carriers, hotels, and other service providers and will not be liable for acts of god or death, personal injury, for loss of objects, acts of god, inclement weather, actions or policies of government, civil disturbances, strikes, accidents, delays, and any other problems beyond the control of our company. Finally, the fact of the registration to take part in any of the services that are offered in this proposal, involves the full compliance to all and every one of the general conditions.
Prices and payments: Prices are based on the number of passengers and in the currency requested by the provider, payable at the rate of exchange applicable on the day of broadcast for each payment. All rates are subject to changes and variations, to receive payment of the deposit required to confirm your reservation. To confirm the services, DEMARE TRAVEL will provide the date of final payment are defined by the PROVIDER , it is the responsibility of the CUSTOMER to comply with the payment on the due date.
Payment methods: The payment methods are according to the conditions of each PROVIDER, DEMARE TRAVEL recommends the CUSTOMER to pay for the trip with a credit card. DEMARE TRAVEL accepts cheques and transfers in mexican pesos and u.s. dollars according to the payment policies of each PROVIDER. DEMARE TRAVEL does not recommend the payment in cash. In case the CUSTOMER decides to make a cash deposit to the bank account of DEMARE TRAVEL, the company has the right to collect the necessary information with accordance of the Rules of the General Character referred to in the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin (the Rules) and in compliance with the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Origin (LFPIORPI) or Law “Anti-Laundering” and its Regulations.
Fees, gratuities, fees and taxes: Planning a trip involving components of flights or cruises are subject to price increases additional tax by the SUPPLIER and/or government even after you have completed your purchase. Unless otherwise statedfare does not include gratuities and other personal expenses such as alcoholic beverages, spa services, casino, transfers, etc
Vendor contracts: PROVIDERS of services including cruise lines, hotels, airlines, tour operators, ferry, train and companies rent a car have their own contracts covering the penalties for cancellation between such other terms and conditions, and is subject to these has been notified by the supplier or not.
Charges of Professional Service: DEMARE TRAVEL reserves the right to charge a non-refundable fee in certain cases, such as trip cancellation for $50 per passenger. As well as the planning services which are not mentioned in the quotation according to its complexity.
Cancellations, Changes and/or Refunds: It is the responsibility of the CUSTOMER to be aware of the cancellation policy of the SUPPLIER, which are not necessarily the day of the final payment. DEMARE TRAVEL reserves the right to charge an administrative fee if you cancel or change your initial trip, in addition to the fees charged by the PROVIDER. The CUSTOMER shall send to DEMARE TRAVEL by e-mail cancellation request to travel as well as the payment of the administrative fee prior to the cancellation date specified by the PROVIDER.
In the case of refunds, you will need to check the terms and conditions that apply to the following providers involved. No refunds will be made for services not used by the decision of the CLIENT in situations where the service does not have impairments to be prestate.
Documents of Travel, Health, Vaccinations and Safety: The CUSTOMER assumes total and full responsibility of reviewing (a) all conditions regarding health, safety, security, political stability, labor or civil(s) destination(s) and (b) verifying that all who travel in their group comply with the requirements of passport, visa, mandates of health, vaccination, or other entry requirements for your(s) destination(s). The omission of having your own documents will result in the denial of a trip without refund. In most cases, your passport must be valid 6 months after arrival date of the trip. If the CLIENT is pregnant or traveling with children, you must notify DEMARE TRAVEL to discuss the special permits and documentation required for cruise ships and other authorities.
Travel insurance: The personal insurance and medical expenses of the CUSTOMER may not have coverage while you are traveling. If the CLIENT requests to cancel the trip for any reason, cause both serious and non-account with a cancellation insurance, I could not make a claim and lose the trip. DEMARE TRAVEL recommends that the CLIENT will want to consider purchasing a travel insurance. You will advise the CLIENT of the options, however, no description or representation of a security mentioned by the staff of DEMARE TRAVEL is any promise on it. If the CUSTOMER decides to decline the travel insurance, DEMARE TRAVEL will require a signed document where the CLIENT assumes full financial liability associated with the loss of the trip, either by mail, scanning, or in person prior to the delivery of the final documents of the trip. DEMARE TRAVEL is not responsible for the policies imposed by the insurer. In case you need support to solve any case of loss, the CUSTOMER will deal directly with the insurer.
CRUISE ships:
Flight: DEMARE TRAVEL recommends that the CLIENT get to the port a day before the departure of your cruise to have a boat more relaxed and safe. If the CUSTOMER decides to arrive the same day of shipment, DEMARE TRAVEL recommend that you consider enough time for any inconvenience or delay of flight. In most cases, the PROVIDER waits for the CLIENT to be present to make your check-in 90-120 minutes before the time of departure of the ship. For any reason, the SUPPLIER will wait for the CLIENT, it is the responsibility of the CUSTOMER to reach the next port, if it were to be the case and the PROVIDER allows.
Cabin Guaranteed : If the CUSTOMER chooses a cab guaranteed, the PROVIDER will assign you a room in a later date, entirely at their discretion, in the category that the CUSTOMER has purchased or higher. Even when it can happen, “upgrades”, there is no promise that this will happen. Not allowed to make any requirements about these cabins. If the location inside the boat it is important for the CUSTOMER, this does not need to reserve a cabin, guaranteed. At the time that the PROVIDER assign the cab to the CLIENT, it will not be possible to make any changes.
Change of Itinerary: The CUSTOMER understands that you are buying a cruise, not an itinerary. The PROVIDER reserves the right to omit and/or change routes and/or ports if necessary. Dinner: DEMARE TRAVEL will communicate to the SUPPLIER the preferences of dinners (schedules, flexibility, size of table) of the CLIENT when applicable. The majority of the cruise lines to consider this only as a request, not a confirmation. The CLIENT must communicate with the gerente of the restaurant when you board the boat if you want to change the assignment of your table.

Under that DEMARE TRAVEL, through its web page www.demaretravel.com as a Travel Agency on the internet, serves as an agent bookings only as an INTERMEDIARY between The USER and the PROVIDER or direct SUPPLIERS of tourist services advertised on this SITE. Do not and will not assume any liability generated by the relationship between the USER and the Providers End of Services, so that the "USER" releases DEMARE TRAVEL over any responsibility, to any failure or lack of compliance on the part of the VENDOR or direct SUPPLIERS of tourism services, including without limitation any failure or breach on the part of the shipping lines, airlines, hotels, and all kinds of boats, transportation agencies, tour operators, and in general, on any failure or lack of compliance on the part of all those tourist services that are provided directly by one or more SUPPLIERS and not directly by DEMARE TRAVEL.
In the same way, DEMARE TRAVEL will not be responsible and The "USER" release of all liability to DEMARE TRAVEL in respect of:
- The accuracy of the photos displayed in your "SITE", under the understanding that are provided to DEMARE TRAVEL to its insertion by the direct SUPPLIERS of the services;
- The star rating assigned to the cruise lines and hotels, is based on the interpretation of DEMARE TRAVEL and may differ from the categories reported in other places.
- The descriptions of the travel services are updated by DEMARE TRAVEL constantly, these descriptions of the travel services are provided by the direct SUPPLIERS of the services in such a virtue, descriptions of travel must be guaranteed by them.
- Any type of fault on the part of The "USER" to obtain the documentation required for your trip, as set forth but not limited to, passports, visas, certificates, etc.;
- Any type of fault on the part of The "USER" to follow travel instructions, including, but not limited to, departure times, airport, hour and date of entry and exit in hotels, coupon redemption policies etc.;
- With regard to the terms and conditions and/or policies of the PROVIDERS of direct services. DEMARE TRAVEL does not assume any responsibility and The "USER" in this act frees them from all responsibility to DEMARE TRAVEL, as well as any claim, cost, expense or loss which The USER may suffer, including any personal injury or other third parties, accident or death, damage to personal property, loss of fun, anger, disappointment, distress or frustration, whether physical or mental, that are a result of:
- Acts or omissions of any other person who is not DEMARE TRAVEL or its employees;
- Illness, theft, labor disputes, mechanical failures, quarantine, government actions, weather or any other cause beyond the direct control of DEMARE TRAVEL;
- Impossibility of the "CLIENT" to travel by not having the required documents such as, but not limited to passports with at least 6 (six) months validity after the end of the trip, visas, personal identification, prescriptions or medical documents and certificates, permits and health and all documents required by the airport authorities, customs, maritime, and air from Mexico and the countries they visit, also note that some countries require that your passport must have at least two free pages of stamp or visa.
- Any failure or fault on the part of the direct VENDOR to provide the service;
- Any failure or fault on the part of "CUSTOMER" in the moment, enjoying the contracted services;
- Any failure or lack of the "CLIENT" to observe or comply with the terms and conditions, policies, instructions, recommendations, security measures, among others from SUPPLIERS to the end of the service;
- Cases of force majeure or unforeseen circumstances such as strikes, delays, cancellations of flights, earthquakes, war, hurricane, and in general any other event that is unpredictable and not be attributable to DEMARE TRAVEL;
- Breach of the "CLIENT" to follow instructions, including, but not limited to flight departure, time, and date of entry and exit in hotels, shipping, and coupon redemption policies;
- Any other event that is not under the direct control of DEMARE TRAVEL.
Any claim or written notice against DEMARE TRAVEL must be received no later than 30 (thirty) days after returning from their trip, and The USER shall be responsible for checking that the final SUPPLIER has special services as may be access, amenities, and services for people with different abilities, physical or otherwise, which it is suggested that you do so prior to the completion of your Reservation. The USER shall be responsible to read and abide by the terms and conditions and/or policies of the PROVIDERS end of services.
The total reimbursement shall not be applicable in situations in which the trip has to be cancelled, interrupted and/or postponed by DEMARE TRAVEL, for reasons that are outside of its control due to force majeure, set forth, but not limited to, weather, hurricane, earthquakes, acts of terrorism, etc., and on which the contractual obligations of DEMARE TRAVEL with its SUPPLIERS do not allow to get refund of the amount paid or to be paid to the SUPPLIER by the customer.
Laws and applicable jurisdiction:
These Terms and Conditions, and any service or product sold on their quality of INTERMEDIARY by DEMARE TRAVEL SA DE CV through to your site www.demaretravel.com., shall be governed by the laws and Courts of the City Monterrey, Nuevo León.
